DEFINITIONS

”AFW” is Studio 100 – A Fancy Wall, located at 2817 Miller Ranch Rd. Suite 325 Pearland, TX 77584.

“Renter” is the person or entity (if provided) renting the AFW.

“Renter’s Associates” are guests, invitees, contractors, and all other persons whatsoever who interact with AFW during the rental period, whether or not such persons did so with the Renter’s knowledge or consent.

The “Rental Period” is the timeframe during which Renter has reserved AFW.

The “Rental Date” is the first day of the Rental Period.

GENERAL

Renter must be 21 years of age or older in order to reserve AFW. Renter must present a valid state ID, Driver’s license, or passport at the time of booking. A copy of Renter’s identification will be kept on file for verification purposes only.

DATES/TIMES OF PERMITTED USE

Renter may only utilize the AFW display wall within the timeframe specified and agreed upon.

PAYMENTS, DEPOSITS, & CANCELLATION

At the time of booking, Renter is required to pay a deposit of 50% of the total rental cost. The 50% deposit is NON-REFUNDABLE. The remaining balance is due no later than 30 days prior to the rental date. If the balance is not paid by the 25th day prior to the rental date, the rental will be automatically canceled, and Renter will forfeit their deposit. AFW has the right to cancel a rental for non-payment.

A Security Deposit in the amount of $600 is required and a credit card to hold such deposit must be provided to AFW at two days prior to the rental date. The Security Deposit will be held via Stripe and Renter’s credit card will not be charged (but will be seen as “pending”) during the rental period. Unless AFW deems it necessary, in order to repair any damage inflicted upon the AFW display wall by Renter and/or Renter’s Associates, the Security Deposit will be released to Renter following the expiration of the rental period. If damages exceed the reserved $600 amount, AFW can charge up to an additional $800 to cover damages. AFW will process the Security Deposit transaction as quickly as possible. However, this process may take up to 7 business days following expiration of the rental period to be completed.

Renter will not receive any portion of the non-refundable deposit in the event that a rental is canceled or postponed. A cancellation/transfer fee of $150 will be charged at the time of cancellation/transfer.

If a rental is canceled at least 30 days prior to the rental date, Renter may apply the 50% deposit toward a future rental date (transfer); payments made in excess of the 50% deposit can be refunded to Renter or applied toward a future rental date. The transfer date must be within 12 calendar months of the original rental date. Only one transfer is allowed per rental.

If a rental is canceled less than 30 days prior to the rental date, all payments made are nonrefundable, and Renter is responsible for payment of any remaining balance.

AFW reserves the right to take all legal steps to collect any balances that are unpaid and owed by Renter to AFW.

DELIVERY/SETUP/PICKUP

Renter is not allowed to pickup the AFW display wall. AFW will deliver/setup and pickup all rental items with the timeframes specified during the reservation process. AFW requires no less than 1 hour for setup. Renter must specify a delivery/setup time that comfortably allows AFW to complete the setup process prior to the start of Renter’s event. Renter must specify the pickup time at the time of reservation. Renter understands that AFW provides service to multiple parties outside of Renter, and any requests for changes in delivery/pickup times after confirmed reservation times can cause disruptions in business and are not guaranteed to be honored. Renter understands that additional fees may apply to accommodate requests made after Renter’s confirmed reservation.

DECORATION

Renter is not allowed to add any decorative or utility items to the AFW display wall without the expressed written consent from AFW. Renter may only place items on the designated coasters within the AFW display wall. Renter shall not place items on the AFW display wall coasters that are oversized, and/or that do not comfortably fit onto the coaster and conveyor track without interrupting the conveyor’s motion.

LIABILITY

AFW shall not be liable to Renter, Renter’s Associates, or any other person for any direct, indirect, incidental or consequential damage, injury, illness, infection or loss to Renter, Renter’s Associates, or any other person for any personal property damage, personal injuries, or infection contracted in, on, or about AFW for any reason during the rental period, unless the damages or injuries were solely caused by or due to intentional acts, omissions, or misconduct of AFW, it’s employees, agents or representatives. Renter holds harmless and indemnifies AFW and its owners, agents, representatives, associates, officers, employees, guests and tenants against any suit, claim, loss, accident, infection, illness, judgment, fine, injury or damages, including reasonable attorney’s fees. This indemnification shall continue in full force and effect during and after the term of the rental for such causes arising during the term of the rental.
